Introduction
Welcome to the charging station network of Energy Zone (the "Terminals"), as well as on our website https://zoneenergie.ca and all associated pages (the "Sites"). These Terms and conditions of use govern your use of the Kiosks, Sites and associated mobile application provided by Energy Zonelocated at 186 rue de Normandie, Suite 101, Boucherville (Quebec), J4B 7J1, Canada. By using these services, you fully accept these conditions.
Acceptance of Terms of Use
By using the recharging services provided by Energy Zone and charging stations on our network, you agree to accept these Terms and conditions of use. These terms constitute a legally binding contract between you and Energy Zoneand you agree to abide by them.
If you do not wish to accept these terms, you must immediately stop using our services. Use of the services after a change in the Terms of Use implies your acceptance of the new terms.
Use of Recharge Services
- Users :
- Guest A guest can use the service to pay for and benefit from a one-off recharge at charging stations connected to the Energy Zone without registering or creating an account.
- Driver A driver must download the mobile application Energy ZoneRegister and maintain an active account in order to make full use of the service's functionalities, including searching for charging stations, managing payments, consulting charging history and accessing reserved charging options.
- RFID user (FOB key) A user registered with an RFID device can start a recharge using his or her device, while being linked to a payment account.
- Services Offered :
- Energy Zone provides recharging services via a network of charging stations, with payment management and access to features such as selection of payment methods, search for available charging stations, and access to promotions for designated users. Access to charging stations is secure, and you can choose your charging preferences and receive notifications on the status of your charging session.
- Access and Login :
- Energy Zone grants you a limited, non-exclusive, revocable license to use the service. You must ensure that your mobile device, or any other device you use to access the services, is compatible with our application. It is your responsibility to ensure the security of your account and to protect your login information.
Pricing
- Pricing structure The pricing charging services is based on a number of criteria, including the duration of the charge, the power consumed by your vehicle, the location of the Station, and the pricing policies of the charging station hosts. Charging fees are clearly displayed on each Kiosk and on the mobile application.
- Price changes : Energy Zone reserves the right to modify its rates at any time, in particular as a result of changes in operating costs, investments in infrastructure, or pricing policy decisions by Kiosk hosts. Any change in rates will be notified in the application or on the website. You are responsible for regularly checking the current rates.
- Penalties and additional costs In the event of non-payment or non-compliance with the rules of use, Energy Zone reserves the right to add additional charges, including late fees or damage penalties, as well as charges for any other breach of our Terms of Use.
- Payment and billing You agree to provide accurate payment information and to maintain a valid means of payment. Energy Zone uses third-party payment service providers to process your payments, and you agree that Energy Zone charges the amount due directly to your account.
Carbon Credits
- Ownership of Carbon Credits Carbon credits generated by the use of our charging station network, as a result of the reduction in greenhouse gas (GHG) emissions by electric vehicle users, are the exclusive property of Energy Zone. These credits are allocated to Energy Zone to support its green initiatives and efforts to reduce carbon emissions.
- Unbundling and Calculation of Carbon Credits for Terminal Owners If a customer owns a charging station and wishes to unbundle or transfer the carbon credits generated by the use of his station, additional charges will be applied to cover the administrative and calculation costs associated with managing the carbon credits. These fees will be detailed in the service contract specific to each Base owner.
- Calculating Carbon Credits : Energy Zone is responsible for calculating the carbon credits associated with each use of the Charging Stations. Users, in particular those who own charging stations, can receive information about the carbon credits they have accumulated. However, the Energy Zone reserves the right to adjust calculations according to government policies and carbon credit certification requirements.
- Transfer or use of Carbon Credits In the event of transferring carbon credits to a third party or using them for environmental programs, administrative fees may apply. These fees cover the certification, monitoring and transfer of carbon credits. These fees will be determined on an annual basis and clearly communicated to the customers concerned.
Limited liability
- Damage to the Vehicle or Charging Station : Energy Zone will not be responsible for any damage caused to your vehicle during the charging process, nor for any malfunction or failure of the charging station. You are solely responsible for the condition of your vehicle and the integrity of your vehicle's connection to the Base.
- Service interruption : Energy Zone cannot be held responsible for service interruptions due to external events such as power failures, unscheduled maintenance, technical errors or problems with network connections. In the event of temporary unavailability of the Kiosks, Energy Zone will make every effort to restore access as soon as possible.
- Exemption in case of Force Majeure : Energy Zone cannot be held responsible for damage or service interruptions due to unforeseen events or force majeure, such as natural disasters, acts of terrorism, pandemics or social unrest.
Intellectual Property
- Copyright and Trademarks All content, including the software used to manage the Charging Stations, is protected by copyright and is the exclusive property of Energy Zone or its partners. You may not copy, distribute, modify or use these contents without prior authorization.
- License Agreement : Energy Zone grants you a limited license to use the services for personal, non-commercial purposes. Any commercial use, modification or redistribution of these contents is prohibited without the written consent of Energy Zone.
Limitation of liability
- Liability for Damage : Energy Zone shall not be liable for any direct, indirect, special, incidental or consequential damages resulting from the use of the Kiosks or the Sites. This includes financial loss, loss of data or damage to your vehicle or other property.
- Overrun of Amounts : Energy Zone will not be held responsible for any costs or losses incurred as a result of amounts in excess of the normal usage charges for top-up services, nor for the consequences of technical errors in billing.
Laws and Protections Applicable to Electric Vehicle Charging
- Regulations on Electric Vehicle Charging Services
- Motor Vehicle Safety and Charging Equipment Act In Canada, the Motor Vehicle Safety Act and related regulations define minimum safety requirements for charging stations. These regulations ensure that charging stations meet safety criteria such as protection against short-circuits, overloads and fire hazards.
- Consumer Code and Tariff Transparency The consumer protection law protects users against unfair commercial practices. Tariffs for recharging services must be transparent and clearly displayed before the service is used.
- Personal Data Protection and Privacy Act The Personal Information Protection and Electronic Documents Act (PIPEDA) of Canada governs the collection and use of consumers' personal information.
- Environmental Standards and Ecological Responsibility
- Greenhouse gas emission reduction standards : Canada and several provinces offer green incentives for electric vehicles and recharging infrastructures, helping to reduce the number of COâ‚‚ emissions. Energy Zone supports these initiatives by installing charging stations powered by renewable energy sources.
- Sustainability standards for charging stations : Energy Zone complies with strict ecological standards, promoting energy efficiency and the use of clean energy to recharge electric vehicles.
- Consumer rights and complaints
- Right of access to pricing information : Under consumer legislation, users are entitled to clear and comprehensive information on the prices of top-up services before committing to a transaction.
- Dispute Resolution and Claims : Energy Zone is committed to resolving any complaints about the service fairly and promptly, and users have the right to submit a complaint if necessary.
Modifications and Cancellation of Terms
Energy Zone reserves the right to modify these Terms of Use at any time. Any changes will be effective upon publication of the updated terms on our website. You will be informed of any material changes by notification in the mobile application or by email. If you do not agree to the changes, you may cancel your use of our services at any time.
Liability for Vandalism and Intentional Damage
In the event of vandalism or deliberate damage to your vehicle or the charging station, Energy Zone cannot be held responsible. You undertake to report any acts of vandalism or damage and to take the necessary steps to minimize future risks. If damage is caused by your own negligence or in violation of the rules of Energy Zoneyou will be responsible for repairing the damaged equipment or station.
Compensation
You agree to indemnify and hold harmless Energy Zone against any claim arising from the use of the services, non-compliance with the Terms of Use, or any illegal action you may take while using the Kiosks.
Applicable Laws and Dispute Resolution
The present Terms of Use are governed by the laws of France. province of Quebec and the federal laws of Canada. In case of conflict, any legal action will be subject to the exclusive jurisdiction of the courts of the province of Quebec.
Users may also have recourse to mediation or arbitration in the event of a dispute concerning the use of recharge services, in accordance with the applicable laws on dispute resolution.
